The last thing I heard said that Christopher Tolkien has stated quite plainly that "none of my father's books could be given a propper treatment as films", and as a result isn't willing to sell the rights to make a film of any of them (the rights to LotR were sold by JRR Tolkien himself before he died). Has this changed?

The rights to the Hobbit have already been sold and are owned by New Line. However the distribution rights are held by MGM which is likely to cause confusion. Also I think that Christopher Tolkien has somewhat shot himself in the foot by appearing in the Return of the King film.
